Judge Tosses Wolff Suit, Clearing Path For $1B Melania Claim

A federal judge in ManhattanMary Kay Vyskocil, has officially dismissed a lawsuit filed by journalist Michael Wolff against Melania Trump. In a sharp-tongued ruling, the judge—an appointee of President Donald Trump—characterized the litigation as a “contorted” attempt to use the legal system and a display of “inappropriate tactical gamesmanship.” While acknowledging that a “real dispute” exists between the two parties, Judge Vyskocil refused to let the federal court be “drafted to oversee an abusively presented spat,” ultimately dismissing the case to be litigated through standard legal channels.

The legal friction began last year when Alejandro Brito, the attorney for the former First Lady, issued a stern letter to Wolff demanding he retract statements regarding her. The letter warned that Melania Trump would have “no alternative” but to sue if the journalist did not comply. In response, Wolff launched a preemptive lawsuit in state court in October, which was later moved to federal court. Wolff alleged that the Trumps maintain a practice of using costly legal threats to intimidate critics and extract “North Korean-style confessions” and apologies, arguing that his comments—including describing their union as a “sham marriage”—were protected opinions. Central to the controversy are allegations linking Melania Trump to Jeffrey Epstein, the disgraced financier who died in jail in 2019. The First Lady has vehemently denied any association with Epstein, decrying the rumors as “malicious and defamatory falsehoods” created by individuals “devoid of ethical standards.” Her legal team has argued that Wolff’s assertions caused her “overwhelming reputational and financial harm.” Although Wolff clarified in his lawsuit that he never accused her of criminal activity, the fallout previously led The Daily Beast to retract an article based on an interview with him following legal pressure from Brito. The ruling has sparked varied reactions within Congress. Republican Representative Nancy Mace praised Melania Trump for her stance against Epstein-related falsehoods and her advocacy for victims. Meanwhile, Democratic Representative Robert Garcia took the opportunity to call for public hearings, suggesting that the First Lady’s own public statements warrant a closer look by Chairman Comer and the broader investigative committees. Despite the dismissal in federal court, the battle over defamation and free speech between the journalist and the Trump family appears far from over.
