U.S. Supreme Court Declines Challenges to Delaware and Maryland Gun Laws

TheĀ U.S. Supreme CourtĀ has formally declined to hear two significant cases challenging state-level firearm restrictions, effectively leaving lower court rulings in place forĀ DelawareĀ andĀ Maryland. In the first instance, the justices rejected an appeal regardingĀ Delaware’sĀ ban onĀ assault-style riflesĀ andĀ large-capacity magazines. This legal challenge, spearheaded by theĀ Firearms Policy CoalitionĀ and theĀ Second Amendment Foundation, sought to overturn 2022 statutes prohibiting the sale of firearms like theĀ AR-15Ā andĀ AK-47. While existing owners may keep their weapons under strict conditions, the law limits new purchases and caps magazine capacity at 17 rounds. Separately, the court turned away an appeal fromĀ Maryland Shall IssueĀ concerning the state’s rigorousĀ handgun licensingĀ requirements. Plaintiffs argued that the vetting process overstepped constitutional boundaries, but the high court chose not to disturb a lower court’s ruling that found the law aligned withĀ Second AmendmentĀ protections. These decisions are notable because the court’sĀ 6-3 conservative majorityĀ has traditionally favored anĀ originalist interpretation of gun rights. By stepping back, the justices avoid immediate intervention in the volatile debate over state regulatory power. This judicial restraint occurs amidst a complex landscape where further challenges, includingĀ Rhode Island’sĀ magazine limits, remain pending. AlthoughĀ FBI crime statisticsĀ suggestĀ handgunsĀ are involved in the majority of homicides, lawmakers continue to focus on semiautomatic rifles due to their prevalence in mass shootings. For now, theĀ Supreme CourtĀ permits these state-specific restrictions to persist, maintaining the legal status quo for residents in the affected jurisdictions.
