McInerney’s investigation scrutinized a critical 52-second gap where the courtroom’s audio recording was deactivated at Judge Joseph’s request. Prosecutors initially alleged this was a deliberate move to coordinate the escape. However, the inquiry found that while the judge engaged in an unauthorized “off-the-record” conversation—breaking judicial rules—she remained unaware of the specific plan to facilitate the defendant’s flight. The report dismissed conflicting testimonies from an interpreter and instead favored the accounts provided by the judge and another attorney, confirming that Judge Joseph believed the defendant merely needed private space for legal counsel. Despite being cleared of a criminal conspiracy, the inquiry recommended that Judge Joseph face public chastisement. McInerney noted that her deviation from protocol created a significant “impression of bias and impropriety.” The Massachusetts Commission on Judicial Conduct (CJC) has maintained its formal accusation of “willful judicial misconduct,” asserting that her actions were prejudicial to the administration of justice. The report emphasizes that even if the aid was accidental, the judge’s decision to bypass standard transparency protocols invited public suspicion and undermined the integrity of the court.
