A high-stakes state inquiry has concluded that Judge Shelley Richmond Joseph of Boston, Massachusetts, did not intentionally assist an undocumented immigrant in evading federal authorities. While the case sparked national debate over judicial conduct and immigration enforcement, Hearing Officer Denis J. McInerney determined that the judge’s actions, though rule-breaking in nature, were not part of a premeditated conspiracy to subvert the law. The investigation found that Judge Joseph had no actual awareness of the escape plot that allowed the defendant to bypass Immigration and Customs Enforcement (ICE) agents. The incident centered on Medina-Perez, a defendant facing drug possession charges and a fugitive warrant from Pennsylvania. An ICE agent was stationed at the courthouse, prepared to take him into custody upon his release. During the proceedings, Judge Joseph allowed the defendant to return to the courthouse lock-up area, ostensibly to consult with his attorney, David Jellinek. It was during this transfer that the defendant’s lawyer and a court officer, MacGregor, worked together to facilitate his exit through a rear sally-port door using a security access card. Medina-Perez, who is now barred from the United States until 2027, successfully fled the building unnoticed.
McInerney’s investigation scrutinized a critical 52-second gap where the courtroom’s audio recording was deactivated at Judge Joseph’s request. Prosecutors initially alleged this was a deliberate move to coordinate the escape. However, the inquiry found that while the judge engaged in an unauthorized “off-the-record” conversation—breaking judicial rules—she remained unaware of the specific plan to facilitate the defendant’s flight. The report dismissed conflicting testimonies from an interpreter and instead favored the accounts provided by the judge and another attorney, confirming that Judge Joseph believed the defendant merely needed private space for legal counsel. Despite being cleared of a criminal conspiracy, the inquiry recommended that Judge Joseph face public chastisement. McInerney noted that her deviation from protocol created a significant “impression of bias and impropriety.” The Massachusetts Commission on Judicial Conduct (CJC) has maintained its formal accusation of “willful judicial misconduct,” asserting that her actions were prejudicial to the administration of justice.
