Trump Administration Announces Nationwide Investigation Into Alleged H-1B Visa Fraud

The Trump administration has launched a nationwide investigation into alleged abuse of U.S. employment-based visa programs, with Vice President JD Vance and the Department of Labor’s Office of Inspector General describing the initiative as a significant effort to strengthen immigration enforcement and protect American workers.

Announcing the investigation at an anti-fraud event in Milwaukee, Vance said the administration is committed to preventing fraudulent visa practices that he argued have disadvantaged U.S. workers. He accused some employers and overseas labor brokers of exploiting the H-1B visa program to replace qualified American employees and suppress wages.

“What we’re doing in the Trump administration, we’re saying, ‘No more,'” Vance said, emphasizing the administration’s commitment to enforcing immigration and labor laws.

Labor Department Inspector General Anthony D’Esposito said federal investigators have already issued dozens of subpoenas as part of a broad inquiry into alleged fraud involving H-1B visas and employment-based green card applications.

According to D’Esposito, investigators are examining claims that certain employers and labor brokers submitted fraudulent visa petitions, required foreign workers to participate in wage-kickback arrangements, or paid wages below federally required standards. He also alleged that some investigations involve suspected connections to forced labor operations, human trafficking networks, transnational criminal organizations, and other forms of organized fraud. Those allegations have not been proven and remain under investigation.

Officials said the inquiry extends beyond the technology industry and includes sectors such as healthcare, manufacturing, engineering, and other industries that rely on skilled foreign workers. Investigators are reviewing whether fraudulent employment practices may have displaced American workers or resulted in the improper issuance of immigration benefits.

The H-1B visa program allows U.S. employers to hire foreign professionals for specialty occupations requiring specialized knowledge and, in most cases, at least a bachelor’s degree. The program is widely used by technology companies, healthcare providers, universities, financial institutions, and manufacturers to fill highly skilled positions.

According to the Pew Research Center, a majority of H-1B visa recipients are citizens of India, with many employed in computer science, engineering, healthcare, and related technical fields. The highest number of approved H-1B petitions are issued in states including California, Texas, New York, Illinois, and Washington.

Administration officials said the investigation is part of a broader effort to strengthen oversight of employment-based visa programs, combat immigration-related fraud, and ensure that U.S. immigration laws are enforced while protecting employment opportunities for American workers. The investigation remains ongoing, and officials said additional enforcement actions could follow as evidence is reviewed.
